1. Acceptance of Terms

By accessing or using BidAlert ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BidAlert provides AI-powered tender intelligence and bid writing tools for Australian construction companies. The Service includes tender discovery, AI classification, bid generation, and related features.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription and Payment

Paid features require an active subscription. Subscriptions are billed monthly or annually as selected. You may cancel at any time; access continues until the end of the current billing period.

5. AI-Generated Content

Bid responses and analyses generated by our AI are provided as drafts and recommendations only. You are solely responsible for reviewing, editing, and submitting any tender response. BidAlert does not guarantee the accuracy, completeness, or suitability of AI-generated content.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described therein.

7. Intellectual Property

Content you provide (company profiles, bid answers) remains yours. AI-generated bid content is licensed to you for your use. The Service, including its design, code, and branding, is owned by BidAlert.

8. Limitation of Liability

To the maximum extent permitted by Australian law, BidAlert shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including failed tender submissions or inaccurate AI outputs.

9. Termination

We may suspend or terminate your access for violation of these terms. You may delete your account at any time by contacting support.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
